§ 1 - Description of the services

  1. An overview of the exact service description can be found on the respective product pages. The information provided there becomes a binding technical component of the contract for the services.

 

§ 2 - Conclusion of the contracts

  1. The provider provides its customers with an online shop system at wp-codings.de. The customer can use this to place a binding order for the desired licence. This concludes the contract.

    The order is placed in the following steps:

    1) Selection of the desired goods
    2) Confirm by clicking on the "Add to shopping basket" button 
    3) Checking the details in the shopping basket
    4) Press the "Continue to checkout" button 
    5) Login to the online shop after registering and entering the login details (e-mail address and password). 
    6) Re-check or correct the respective data entered.
    7) Binding dispatch of the order by clicking the button "order with costs".
    Before submitting the binding order, the consumer can return to the website on which the customer's details are recorded and correct input errors or cancel the order process by closing the Internet browser by pressing the "Back" button contained in the Internet browser used by him after checking his details. We confirm receipt of the order immediately by means of an automatically generated e-mail ("order confirmation"). With this we accept your offer.

 

§ 3 - Data collection and storage

  1. The provider collects and processes the data required to provide and invoice the services to the customer. These are inventory data, usage data and billing data. In all other respects, the data protection provisions of our contract for order processing in accordance with Art. 28 GDPR apply.

 

§ 4 - Payments and prices

  1. Unless otherwise agreed, the fees for the billing period selected in the order are to be paid in advance.
  2. We accept payment by credit card (Stripe).
  3. The prices stated on the provider's website are intended for traders and do not include statutory VAT.

 

§ 5 - Obligations of the customer

  1. The customer assures that he is an entrepreneur and has a valid VAT ID.
  2. The customer is obliged to provide correct and complete personal details when registering and to inform the provider immediately of any changes to these details.
  3. The customer is liable for the misuse of his access data (incl. licence code) by third parties if he is responsible for this misuse.
  4. The customer is aware that the provider has the unrestricted copyright to its code. The customer is not authorised to use the source code or parts thereof in their own free or commercial projects.
  5. The customer is not authorised to publish the source code (e.g. on platforms such as Github).

 

§ 6 - Liability

  1. The provider shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence. Furthermore, the provider shall be liable for the slightly negligent breach of essential obligations, the breach of which jeopardises the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper execution of the contract and on the observance of which is regularly relied upon. In this case, however, the provider shall only be liable for the foreseeable damage typical of the contract. The provider shall not be liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.

    The above limitations of liability shall not apply in the event of injury to life, limb or health or in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected by this. Insofar as the liability of the supplier is excluded or limited, this shall also apply to the personal liability of employees, representatives and vicarious agents.

 

§ 7 - Warranty

  1. The statutory warranty provisions apply.

 

§ 8 - Contract term / cancellation

  1. The term of the contract depends on the package agreed at the time the contract is concluded or selected on the provider's website.
  2. The contractual relationship may be terminated by either party without notice for good cause. The cancellation must be made in writing.

 

§ 9 - Final provisions/jurisdiction

  1. Cypriot law shall apply. The contract language is German.
  2. The place of jurisdiction is Paphos, Cyprus.
